Our Terms and Conditions


The Agreement:

Vacation Nannies is a finders agency matching holiday nannies with clients. These Terms and conditions cannot be changed or modified in any way, unless it has been done so by a Director of Vacation Nannies.

These terms will win over any other terms and conditions sent to us by you or the Nanny. By confirming a booking with Vacation Nannies you agree to the all of the Terms and conditions, which cannot be changed.

Terms of a Finding Agency

Once we have matched a nanny with your family, you agree to pay all fees and accept all of the terms and conditions.

Once the details of a nanny have been issued to you via telephone, email, or writing, you are agreeing to carry on the booking process via our agency.

If you choose to book a nanny who has been introduced to you via our agency, you are agreeing to pay our charges as quoted or shown on our website.

If you decided that you no longer want to use the nanny you have initially booked, you must inform us and we will arrange for you to be introduced to another nanny, you must not contact a nanny personally who have introduced you to. If you do, you will be liable for charges and the Nanny will be at risk of being blacklisted by the Agency.

The details of the nanny and any other information we send to you is strictly confidential and must not be shared with any other person. If you do share the details of another nanny that you have been introduced to by us and they book her privately without our consent, you are agreeing to pay our fees.

Pricing

Once the booking has been confirmed, a 50% booking fee will be requested from you for our services. The outstanding balance will be payable not later than 4 weeks prior to your departure. The booking cannot be confirmed until the booking fee is paid and the outstanding balance is made. The nanny has the right to accept another job offer if you take longer than 7 days to pay the initial booking deposit. You will have to opportunity to meet the nanny prior to the trip. However, you are responsible for paying for all travel expenses, which we will add onto your invoice. We understand some nannies may travel from further afield, so a fair travel cost will be agreed. If you book the nanny after meeting her, you are required to book directly with us. The Nanny will be blacklisted and you will be charged the full amount if you book the nanny privately.

The fees payable to us include the charges payable to your nanny, which we will pay to the Nanny, as your agent. You agree not to exchange any money with the Nanny unless of course, it’s a greatly appreciated tip. Day to day expenses or any additional babysitting duties that are carried out outside of the package and agreed to do so by the Nanny.

If you end up employing your nanny you will be responsible for the payment of any applicable taxes and for any of the nannies employment rights.

If you believe the Nanny has breached the terms of the Nanny agreement you will be responsible for recovering any fees from the nanny, we will not accept any responsibility.

The Nanny is required to provide a childcare service for the all the hours booked as part of the package.

How our service works

The Nanny we introduce to you to will be a UK registered, self-employed nanny and will provide and high standard of nanny service throughout your holiday and is required to follow the guidelines of care we will send you at the time of booking.

We need to have accurate information about your requirements before you engage with a nanny. This will allow us to match your family with the most suitable nanny.

If you choose to employ the nanny

If you book a nanny we have introduced you to, outside of the original holiday booking, you agree to pay a fee to us equal to 20% of the total amount you are paying the nanny. The fee will be payable whether or not you engage the nanny as an employer or independent.

Our fees will be payable in full if we find out that you have booked a nanny we have introduced to you for a holiday or part of a holiday. This will apply for both the holiday in the booking form and to any other holidays you book the nanny for.

Our liability
We will not be held liable to you for any loss you may suffer arising out of or in connection with the provision of any services pursuant to these terms, this may be loss of profit, lost opportunity or lost reputation. Our liability to you in relation to any financial losses suffered by you shall not exceed the charges payable by you for our services.

It is our duty as an Agency to check criminal records bureau searches provided by nannies we introduce to you. Or, if the nanny does not produce searches we will undertake criminal records bureau searches directly. We will also check references supplied by the nanny. Where a nanny has relevant professional or other qualifications we will seek to obtain copies of the relevant certificates. You agree that provided we take these steps we are not obliged to carry out any further background checks on nannies introduced to you.

We cannot guarantee the suitability of any nanny supplied to you and we will not be liable for the acts or omissions of the nanny, who will be directly engaged by you, you are therefore advised to make sure you are satisfied with the nanny before departure.

Please note that if the nanny abandoned their duties during your holiday we will not be responsible for any losses you suffer and we cannot guarantee a replacement, in such circumstances. Our fees will not be repayable to you save for reasonable deductions.

Nothing in these terms will exclude our liability for death or personal injury arising as a result of our negligence.

Travel, accommodation and meals

You agree that you have read the nanny guidelines and agree that the nanny will be provided with return flights, travel expenses, including travel insurance for the nanny, accommodation, meals and all expenses.

Cancelling the booking
After the booking has been made, you are entitled to cancel the booking up to 28 days before the start of the holiday. If you do cancel the booking, the deposit is non-refundable.

If you cancel the booking 28 days or less before the holiday, then you must pay the outstanding balance and no refund will be made.

If the nanny we have matched you with cancels before the holiday, for reasons out of our control, then we will do our best to find an alternative nanny or we will reimburse the amount paid by you.

As noted in the Nanny guideline, and unlikely event of the contract being cancelled during the holiday, you are responsible for organising the nannies return flight and travel home or new accommodation until the date of the booked departure. If you end a nannies contract whilst away, without arranging their journey home then we reserve the right to pay for the travel on your behalf and you will be liable to reimburse the full cost of the travel.

General
This agreement should be governed by the English law in every particular including formation and interpretation and shall be deemed to have been made in England, In addition, any proceeding arising out of or in connection with this agreement must be brought in the courts of England and Wales.

Failure by us at any time to enforce any one or more of the terms and conditions set out above will not prevent us from taking steps to enforce at a later date any right you may have under these terms.

We are an independent contractor and no employment relationship shall be created by any provision of services by us.

We will be entitled to subcontract any of our rights or duties under these terms.
You are not entitled to withhold payment of any sum otherwise payable to us by reason of any claims set off or for damages.
